Should Yarriambiack Shire be able to own the term "silo art trail"

Wimmera's iconic "Silo Art Trail" is caught up in a legal battle over whether or not the term can be trademarked.

Yarriambiack Shire Council has presented a 400 page document to make the case for having ownership over the term through trademark.

Graincorp, Australia's largest grain storage corporation, is fighting the Council's bid to trademark the name, as the company believe it is a generic term used for the art movement, which sees a trail of grain silos decorated by artists.

Yarriambiack Shire Mayor Graeme Massey believes the situation has been blown out of proportion, as Council's only intention is to be recognised as the first trail to exist in regional Australia, which attracts tourism to the area. Mr. Massey says the recognition would come in the form of a logo displayed to honour the Shire as the creators of the movement.

Graincorp's opposes the position due to the fact the Shire could monetise the trademark, charging other people to use it.

A decision is expected in the coming months.
