Rape and sexual assault
A MAN, formerly of Balmoral and now living in the Geelong suburb Highton, and another Balmoral man, have been found guilty of raping a 20-year-old woman in 2016.
Both men, now 24, faced a three-day County Court trial.
A jury of eight men and four women found one of the men, still living in Balmoral, guilty of two counts of rape and one count of sexual assault.
The other man was found guilty of one count of rape.
The court heard the rape took place in a caravan on a Balmoral property, following a 21st birthday party on the night of the incident.
About 3am, the victim and two men were the only people who remained in the caravan with the lights off.
Both men said in court that they believed the sex was consensual but stopped when the victim pushed one of the offender’s chest.
One of the men said they didn’t hear the victim say 'stop'.
Both men were 21 at the time of the incident and both pleaded not guilty to the charges.
The pair will face a plea hearing in Melbourne on April 8.
